Terms of Service

1. Agreement to Terms
By creating an account or using MaGGzin Marketplace ("MaGGzin", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree, do not use the Platform. These terms form a legally binding contract between you and MaGGzin and apply to all visitors, registered users, buyers, sellers, and any other person accessing the Platform.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use MaGGzin. By registering, you represent and warrant that: (a) you are 18 years of age or older; (b) you have the legal capacity to enter contracts; (c) you are not subject to any sanction, export restriction, or legal bar that would prohibit your use of the Platform; and (d) all registration information you provide is accurate, current, and complete.
3. Account Registration & Security
To access most features you must register for an account. You agree to: (a) provide accurate, current, and complete information during registration; (b) keep your credentials confidential and not share them with any third party; (c) notify us immediately at magofficial@maggzin.com of any unauthorized access or security breach; and (d) accept responsibility for all activity conducted through your account. MaGGzin is not liable for losses arising from your failure to secure your credentials.
4. Buyer Obligations
As a buyer you agree to: (a) provide accurate shipping addresses and valid payment information; (b) pay in full for all purchases at checkout; (c) communicate respectfully with sellers; (d) use MaGGzin's built-in dispute resolution before initiating any chargeback with your card issuer — chargebacks filed without first contacting support may result in account suspension; (e) not abuse return or refund processes; and (f) inspect items upon receipt and report issues within the timeframe specified in our Returns Policy.
5. Seller Obligations
As a seller you agree to: (a) accurately describe all products including condition, dimensions, materials, and any defects; (b) only list items you legally own and have the right to sell; (c) fulfill orders within your stated processing time, not to exceed 5 business days; (d) maintain accurate inventory — listing items you cannot fulfill may result in suspension; (e) comply with all applicable federal, state, and local laws including consumer protection, tax, and export regulations; (f) respond to buyer inquiries within 48 hours; (g) honor your stated return policy; and (h) complete identity verification as required before withdrawing funds.
6. Prohibited Items & Conduct
You may not list, sell, or purchase: counterfeit, replica, or trademark-infringing goods; stolen property; prescription drugs or controlled substances; weapons, firearms, ammunition, or explosives; hazardous materials; sexually explicit content; live animals or endangered species products; or any item illegal in the buyer's or seller's jurisdiction. Prohibited conduct includes: creating fake accounts or reviews; using the platform to evade fees or conduct off-platform transactions; sending spam, phishing messages, or unsolicited commercial communications; scraping, crawling, or automated data extraction; and any action that interferes with the platform's security or operations. Violations may result in immediate account termination and referral to law enforcement.
7. Payments, Fees & Rewards
All transactions are processed by Stripe, Inc., a third-party payment processor. By making a purchase, you authorize the charge to your selected payment method. Seller fees. MaGGzin charges sellers a 9% platform commission on the item price of each completed sale (delivery/shipping fees you charge buyers are yours in full — no commission is taken on them), plus a flat $0.75 listing fee per item that is added to the buyer-facing price. Commission is deducted from your payout; the current fee schedule is also shown in the Seller Dashboard and may be updated with 30 days' advance notice. Platform fees are non-refundable except where required by law or where an order is cancelled before fulfillment. Buyer fees. Buyers pay a service fee of 2.5% of the item subtotal, shown at checkout under "Taxes & Fees," which helps cover payment processing and platform costs. This service fee is non-refundable on returns. Sales tax. Under marketplace facilitator laws, MaGGzin — not individual sellers — calculates, collects, and remits sales tax on taxable orders sold through the Platform in jurisdictions where MaGGzin has a tax obligation. Sellers have no separate sales-tax collection obligation for their MaGGzin sales. Sellers remain responsible for their own income taxes; a 1099-K may be issued where thresholds are met. Payouts. Seller earnings and rewards become available 48 hours after delivery is confirmed, then pay out by ACH to the bank account on file (typically 1–3 business days). MaGGzin may issue credits or adjustments at its discretion in connection with dispute resolution. Rewards. MaGGzin Cash: buyers automatically earn 1% back on every order, released 48 hours after delivery. MaGGzin Partnership Program (MPP): users who refer a seller earn 1.8% of that seller's item sales for as long as they sell. Both MaGGzin Cash and MPP earnings can be applied toward any purchase at checkout in any amount, or withdrawn to a linked bank account once the balance reaches $25. Rewards tied to a cancelled or refunded order are reversed. MaGGzin may modify or discontinue any rewards program with reasonable notice.
8. Returns & Refunds
Each seller sets their own return window and conditions, which must be clearly disclosed on their listings. MaGGzin's baseline Return Policy (available at maggzin.com/returns-policy) provides a minimum standard that all sellers must meet. Buyers must initiate returns through the MaGGzin platform — do not ship items back without an approved return request. An approved refund returns the item price and any sales tax collected on it to your original payment method (Stripe's processing timelines apply, typically 5–10 business days). The 2.5% buyer service fee is non-refundable. Any MaGGzin Cash or MPP credit you applied to the order is returned to your rewards balance, and any cashback or referral earnings tied to a refunded order are reversed. 9. Intellectual Property
The MaGGzin name, logo, design, software, and all Platform content are the property of MaGGzin or its licensors and are protected under copyright, trademark, and other intellectual property laws. You retain ownership of content you upload (photos, videos, listings, reviews) but grant MaGGzin a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, display, and distribute that content solely for the purpose of operating and promoting the Platform. You represent that you own or have all rights necessary to grant this license.
10. DMCA & Intellectual Property Complaints
If you believe content on the Platform infringes your copyright, send a written notice to magofficial@maggzin.com containing: (a) your signature; (b) identification of the copyrighted work; (c) identification of the infringing material and its location on the Platform; (d) your contact information; (e) a statement of good-faith belief that the use is unauthorized; and (f) a statement of accuracy under penalty of perjury. Counter-notifications may be submitted by the content uploader following the same procedure. Repeat infringers will have their accounts terminated.
11. Disclaimers & Limitation of Liability
MaGGzin is a marketplace platform and does not manufacture, inspect, or take title to any products listed by sellers. THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. MaGGzin does not warrant that the Platform will be uninterrupted, error-free, or free of viruses. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MaGGzin'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE TOTAL FEES PAID BY YOU TO MaGGzin IN THE 12 MONTHS PRECEDING THE CLAIM. MaGGzin IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
12. Indemnification
You agree to indemnify, defend, and hold harmless MaGGzin and its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any products you list or sell; or (e) any dispute between you and another user.
13. Account Suspension & Termination
MaGGzin may suspend or terminate your account at any time, with or without notice, for any violation of these Terms, suspected fraudulent or illegal activity, chargebacks, or extended inactivity. You may close your account at any time through Account Settings. Upon termination, your right to use the Platform ceases immediately. Any outstanding seller balances will be paid out in accordance with normal payout schedules, less any amounts owed to MaGGzin. Sections that by their nature should survive termination (intellectual property, indemnification, limitation of liability, arbitration) shall survive.
14. Dispute Resolution & Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform that cannot be resolved informally within 30 days shall be settled by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. YOU AND MaGGzin EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION. This arbitration agreement does not prevent you from filing a complaint with a consumer protection agency or seeking emergency injunctive relief from a court.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles. To the extent any claim cannot be arbitrated, you consent to exclusive jurisdiction in the state and federal courts located in Miami-Dade County, Florida.
16. Modifications to Terms
MaGGzin reserves the right to modify these Terms at any time. For material changes, we will provide at least 14 days' advance notice via email or a prominent banner on the Platform. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Platform and close your account.
